Terms of Service

1. Acceptance of Terms

By accessing or using Sitevita.com (“the Platform”), operated by Bakemysite.com, you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the Platform. These Terms apply to all users, including merchants who create stores and customers who make purchases through merchant storefronts.

2. Description of Service

Sitevita is a software-as-a-service (SaaS) e-commerce platform that enables merchants to create and manage online storefronts. The Platform provides tools for product management, order processing, payment collection, shipping integration, customer management, and analytics. Sitevita does not sell products directly — merchants are independent business operators who use the Platform to conduct their own commerce.

3. Merchant Accounts

To create a store on Sitevita, you must register for a merchant account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must provide accurate and complete information during registration and keep your account information current. You must be at least 18 years of age or the age of majority in your jurisdiction to create a merchant account.

4. Subscription & Billing

Sitevita offers a monthly subscription plan. Subscriptions are billed monthly. A 14-day free trial is available for new accounts. After the trial period, your subscription will be charged automatically unless cancelled. You may cancel your subscription at any time through the Billing Dashboard. Cancellation takes effect at the end of the current billing cycle — no prorated refunds are issued for partial months. Sitevita reserves the right to change pricing with 30 days' advance notice via email.

5. Merchant Responsibilities

As a merchant using Sitevita, you are solely responsible for: the legality of products sold through your store; compliance with all applicable laws and regulations in your jurisdiction (including tax collection, consumer protection, and data privacy laws); obtaining necessary licenses and permits for your business; setting and managing your own refund and return policies for your customers; the accuracy of product descriptions, pricing, and inventory levels; obtaining necessary consent before utilizing analytics integrations (such as Google Analytics) on your storefront; and any disputes with your customers, including refunds, chargebacks, and product complaints.

6. Payment Processing

Sitevita facilitates payment processing through third-party providers (Stripe, PayPal, Razorpay). Payments from customers flow directly to the merchant's connected payment account — Sitevita does not hold or process customer funds. Merchants are responsible for configuring their own payment gateway accounts and complying with the respective gateway's terms of service. Sitevita charges zero transaction fees. Payment gateway fees (e.g., Stripe's 2.9% + $0.30) are charged by the gateway provider directly to the merchant.

7. Prohibited Uses

You may not use Sitevita to: sell illegal products or services; engage in fraud, money laundering, or deceptive business practices; distribute malware, viruses, or any harmful code; violate intellectual property rights of others; send spam or unsolicited communications; attempt to gain unauthorized access to the Platform or its infrastructure; use the Platform in any way that could damage, disable, or impair its functionality; or resell, sublicense, or redistribute access to the Platform without written permission.

8. Intellectual Property

The Sitevita platform, including its codebase, design, logos, and documentation, is the intellectual property of Bakemysite.com. Merchants retain full ownership of their product content, images, descriptions, and business data uploaded to the Platform. By using Sitevita, merchants grant us a limited license to display their content on their storefronts for the purpose of operating the service.

9. Data & Privacy

Sitevita collects and processes data as described in our Privacy Policy. Merchants are data controllers for customer data collected through their stores and must comply with applicable data protection laws (including GDPR and CCPA where applicable). Sitevita acts as a data processor on behalf of the merchant. We implement industry-standard security measures including row-level database security, encrypted communications, and PCI-compliant payment processing.

10. Limitation of Liability

To the maximum extent permitted by law, Sitevita and Bakemysite.com shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, data, or business opportunities. Our total liability for any claim arising from these Terms shall not exceed the amount paid by you to Sitevita in the twelve (12) months preceding the claim. The Platform is provided “as is” without warranties of any kind, express or implied.

11. Termination

You may terminate your account at any time by cancelling your subscription and contacting support. Sitevita reserves the right to suspend or terminate accounts that violate these Terms, with or without notice. Upon termination, your store will be taken offline and your data will be retained for 30 days before permanent deletion, during which time you may request a data export.

12. Modifications to Terms

We may update these Terms from time to time. Material changes will be communicated via email to registered merchants at least 30 days before taking effect. Continued use of the Platform after changes take effect constitutes acceptance of the updated Terms.

13. Governing Law

These Terms are governed by the laws of India. Any disputes arising from these Terms shall be resolved through arbitration in New Delhi, India, in accordance with the Arbitration and Conciliation Act, 1996.
